Submitting an Offer

Once you select the property to invest in, you need to submit a Purchase Offer, which we will assist to submit. In this step, is when your Investment File will become handy and will help us prepare the offer, and later on with the purchase agreement.

Once the offer is accepted, there will be a Purchase agreement to be prepared, that will contain each of the terms, conditions and payment information need to proceed with the investment. Both parties will sign this agreement and attach the proper documentation required from the Notary. On the Side, you as a Buyer will have to start the process of opening a Bank Trust, in which you will have our assistance.

Bank Trust or Fideicomiso

Fideicomiso, in Spanish, means Bank Trust. Foreigners can acquire absolute ownership rights to property in Mexico’s borders and Beach Areas, through a Bank Trust. This trust system of ownership is secured by the Government and the Central Bank of Mexico.

It is irrevocable ownership set in 50-year increments, perpetually renewable, and is transferable. When the Fideicomiso/Bank Trust is formed in an authorized bank, the title to the property is delivered to the bank who then becomes the Trustee. The foreign buyer is designated as the Beneficiary (owner) of the Trust. The bank serves as the owner’s employee, and operates solely under the instructions of the Beneficiary.

You, as The Beneficiary have total control over the Trust, retains the use and control of the property, and makes all the investment decisions. The rights to use, enjoy, sell, transfer, inherit, will, and mortgage the property is your Beneficiary’s right, the same as in fee simple ownership. It is your Trust and is not the property of the government or the bank.
